The parents of a baby boy who was decapitated during childbirth have been awarded $2.25 million in damages after a pathologist posted graphic photos and videos of their son's autopsy on social media without their consent. Jessica Ross and Treveon Taylor Sr. filed a lawsuit against Dr. Jackson Gates, the pathologist who performed the autopsy, and his laboratory.
According to the lawsuit, Dr. Gates posted a video of the child's dead body on his Instagram account, showing "graphic and grisly detail of postmortem examination" and his "decapitated, severed head" without the couple's permission. Despite deleting the initial video, Dr. Gates posted two more videos of the autopsy just a few days later.
The jury awarded Ross and Taylor $2.25 million in damages, punishing Dr. Gates for his "reprehensible behavior." The couple's attorney stated that while the verdict cannot ease the pain of losing their baby boy, it holds Dr. Gates accountable for his actions.
Dr. Gates' attorney claimed that his client "deeply, deeply regrets any harm" caused, but in a Facebook post, Dr. Gates called the outcome "a complete miscarriage of justice" and announced his intention to file an appeal. The pathologist continues to post autopsies on social media, sparking concerns about the boundaries of professional conduct.
This case raises important questions about the ethics of sharing graphic medical images on social media and the need for professionals to respect the privacy and dignity of patients and their families.
